Swaraj India welcomes the Supreme Court decision on Delhi power quarrel

ROHIT SHARMA,9818863732 ;- Yogendra Yadav led Swaraj India has welcomed the Supreme Court verdict on the power and jurisdictional dispute in Delhi. The court order should not be seen as a defeat or victory of any political party. Swaraj India has always maintained that while the Lieutenant Governor has acted as a political party's agent, the AAP led Delhi government has used this power tussle as an excuse behind all it's failures.
 
We hope this order brings the much needed clarity and deters both the parties from quarreling at the cost of public service. Let us also hope that neither the positive steps undertaken by the Delhi govt would be obstructed nor will there by any excuses for AAP led Delhi government's failure to deliver on governance.
 
Swaraj India has always stood in support of the demand for full-statehood and believes that apart from some areas in New Delhi like the embassies, parliament, etc and the cantonment area, the national capital of Delhi should be granted full-statehood. The central government should not interfere in the day to day affairs of governance and administration.
 
The Court said in it's decision that LG can only act upon the aid and advice of the council of ministers and that he can not obstruct its functioning. According to the Court, LG's concurence is not required in Delhi Govt's decisions but the Govt will have to keep the LG in loop and communicate each and every decision. In case the LG disagrees with a decision, he can very well refer it to the president. The crux and spirit of the Supreme Court order is that LG and Delhi Govt should act with due respect for constitutional morality, inclination to cooperative federalism and an intent to work together harmoniously for the betterment of people.
 
The SC order is a fair interpretation of the present constitutional position of Delhi and will hopefully serve to settle down the confusion which has been created because of political motives & mala fide intentions and resulted in the break down of the administration despite the people giving an overwhelming mandate to the Aam Aadmi Party.
